Nursery Levy
The nursery products levy has been in place since 1989. It applies to potted plants produced in Australia that are either used by the producer to produce other goods or sold by a producer. Horticulture Innovation Australia Limited and Plant Health Australia (PHA) oversee the expenditure of this levy.
Nursery products include trees, shrubs, plants, seeds, bulbs, corms, tubers, propagating material and plant tissue cultures developed for ornamental purposes or to produce fruits, vegetables, nuts, cut flowers, or foliage. However, seedlings grown in containers for forestry operations are not considered nursery products.
A container is defined as any container designed and used in the production or preparation of a nursery product for sale or use in producing other goods, and that will be the immediate container of the nursery product.
Suppose a person buying the containers intends not to use them for growing leviable nursery products. In that case, they will not be liable to pay the nursery products levy and can lodge a return.
